OAKLAND, Calif. - A California welding fumes plaintiff nearing trial argues in a supplemental response that his former employer's purchase records and other tangible evidence contradict assertions in defendants' summary judgment motions that product identification is lacking. Thomas v. A.O. Smith Corp., et al. [Welding Products Cases], No. JCCP004368 (Calif. Super. Ct., Alameda Cty.).
The supplemental response filed on Oct. 22 by plaintiff Elbert Thomas was ordered by Alameda County (Calif.) Superior Court Judge Robert Freedman and accompanied by Thomas' own declaration and invoices indicating purchases of products by defendant The ESAB Group Inc.
