FRANKFORT, Ky. - The Kentucky Supreme Court has rejected efforts by a former employee of CSX Transportation Inc. to overturn a jury verdict absolving CSX Transportation Inc. of liability for alleged brain damage suffered by an employee who worked with solvents. Burton v. CSX Transportation Inc., No. 2006-SC-000695-DG (Ky. Sup. Ct.).
The high court said in a published opinion on Oct. 23 that it was not error for the trial court to bar any reference to a neuropsychological study of CSX workers and to instruct jurors to ignore causation opinions by Burton's neuropsychology expert.
