NASHVILLE, Tenn. - A special appeals panel concluded on Oct. 6 that a trial court had sufficient evidence to find that a maintenance mechanic's accidental exposure to a disinfectant exacerbated his chronic lung disease and provided a basis for disability benefits. Ritescreen Inc., et al. v. Campbell, No. E2007-01441-WC-R3-WC (Tenn. Sup. Ct., Sp. WC Panel).
The Tennessee Supreme Court's Special Workers' Compensation Appeals Panel rejected arguments by Ritescreen Inc., the employer, and Zurich North America, the workers' compensation insurer, that their medical expert's testimony was more reliable than the claimant's.
