CLEVELAND - Defendants preparing for a Dec. 1 trial date have moved to exclude trial references to non-parties, prior court orders and other matters they say will prejudice jurors against them. Byers v. Lincoln Electric Co., et al., No. 1:04-CV-17033 [MDL No. 1535; No. 1:03-CV-17000] (N.D. Ohio).
Attorneys for CBS Corp., BOC Group and other firms defending claims brought by plaintiff Eddie Byers and his wife filed more than a dozen motions on Sept. 22 to prohibit trial references or bar the presentation of documents or other evidence.
