CHICAGO - An Illinois appellate panel has affirmed a trial court's decision to grant a new trial to Steven A. Boren on claims that his exposure to welding fumes resulted in neurological injuries. ,i>Boren v. The BOC Group Inc., et al., No. 5-06-0679 (Ill. Ct. App., 5th Dist.).
The Fifth District Appellate Court held 2-1 on Sept. 9 that the Madison County (Ill.) Circuit Court did not abuse its discretion in vacating a defense verdict and ordering a new trial based on what it found to be defendants' discovery lapses, and prejudicial evidence and statements to the jury.
