ITW Says Plaintiffs Didn't Address Summary Judgment Arguments

CLEVELAND - Illinois Tool Works contended in a reply brief supporting its motion for summary judgment that plaintiffs in the welding fume MDL failed to address most of their arguments and effectively conceded summary judgment on most causes of action. In re: Welding Fume Products Liability Litigation, No. 1:03-CV-17000 [MDL Docket No. 1535] (N.D. Ohio).

ITW said in its July 21 reply that plaintiffs failed to address five of six categories of counts, and that its arguments in opposition to summary judgment on product liability claims were procedurally and substantively improper.
