CLEVELAND - A second Ohio plaintiff has notified a state court judge this month that he is voluntarily dismissing a class action complaint. Loftus v. Lincoln Electric Co., et al., Ohio Ct. Comm. Pls., Cuyahoga Cty.).
Attorneys for Brian Loftus filed a notice of voluntary dismissal of his class action in the Cuyahoga County (Ohio) Court of Common Pleas on Aug. 22.
The withdrawal of class claims by Loftus follows a similar withdrawal by Richard V. Rector on Aug. 4 (See related story in this issue). Rector was scheduled for trial in February.
