CLEVELAND - An Ohio judge has awarded summary judgment to a respirator manufacturer, citing the plaintiff's failure to provide sufficient evidence that the defendant's product didn't protect her against the inhalation of silica dust. Thompson, et al. v. Air Liquide America Corp., et al., No. 510322 (Ohio Comm. Pls. Ct., Cuyahoga Cty.).

Cuyahoga County Common Pleas Court Justice Francis E. Sweeney ruled July 16 that former cement mason June Thompson cannot show, based on the testimony provided, that any product manufactured by Mine Safety Appliances was a substantial factor in causing her alleged injury.
