Judicial Panel Transfers W.Va. Case to Welding Fume MDL

CLEVELAND - The Judicial Panel on Multidistrict Litigation has transferred a West Virginia case to the Welding Fume Products Liability Litigation MDL despite a pending petition to remand to state court. Barcus v. Airco Inc., et al., No. 3:08-344 [MDL No. 1535, N.D. Ohio] (S.D. W.Va.).

The June 27 transfer of claims by Donald Barcus and Lois Barcus and three other couples became official when it was docketed in the U.S. District Court for the Northern District of Ohio on July 15.
