JAMAICA, N.Y. - Claimants who sued Pulmosan Safety Equipment Corp. for injuries allegedly caused by silica exposure that occurred prior to the company's dissolution may proceed with their claims, a New York appeals court has held. Matter of Ford v. Pulmosan Safety Equip. Corp., No. 08-05695 (N.Y. App. Div., 2nd Dept.).
The Second Department Appellate Division court ruled June 17 that a trial judge did not err when he suspended Pulmosan's dissolution and allowed plaintiffs to sue if their claims arose prior to 1986, when the company dissolved.
