VICKSBURG, Miss. - Defendants in a Mississippi silica case have moved to dismiss claims asserted by the girlfriend of a sandblaster who died before his case was dismissed as improperly venued. Kelley v. Pangborn Corp., et al., No. 07,0076-CI (Miss. Cir. Ct., Warren Cty.).

In a motion for summary judgment filed June 16 in Warren County Circuit Court, the defendants argue that since plaintiff Dave Bozeman's girlfriend wasn't a party to the original complaint, she does not have standing to sue under a savings statute that allowed the case to be re-filed within a year of its dismissal.
