Workers' Comp Moves to Attach Plaintiff's Possible Recovery

NEW ORLEANS - The Louisiana Workers' Compensation Corp. has moved to intervene in a lawsuit by a welder alleging that exposure to welding fumes cause his laryngeal cancer. Pellegal v. Lincoln Electric Co., et al., No. 08-0030 (E.D. La.).
The motion filed in federal court on June 20 will have to be re-filed in the Civil District Court for the Parish of Orleans because of the federal court's remand order on the same day (See the related story in this issue of HarrisMartin's Litigation Watch: Welding Fumes).
