KANSAS CITY, Mo. - Pulmosan Safety Equipment Corp. has filed a motion for summary judgment in a Missouri silica case, arguing that the plaintiff has failed to establish with reasonable certainty that he ever used the company's sandblasting hood. Hardy v. American Optical Corp., et al., No. 0516-CV27381 (Mo. Cir. Ct., Jackson Cty.).
The June 11 motion filed in Jackson County Circuit Court says that plaintiff George Hardy's testimony, at best, only establishes that the hoods used at two sandblasting sites where his alleged exposure occurred "looked similar" to the H-30 Series Sandblast Hood that Hardy claims he wore.
