GULFPORT, Miss. - U.S. District Judge Kathleen M. O'Malley has issued a written order explaining her pre-trial rulings on summary judgment motions in a case that resulted in a $2.42 plaintiffs' verdict. Jowers v. Arcos Industries, L.L.C., et al., No. 1:08-CV-00036-KMO-JMR [In Re: Welding Fume Products Liability Litigation, MDL No. 1535 (N.D. Ohio)] (S.D. Miss.).
Judge O'Malley, who presided at trial and also presides over the federal multi-district litigation in the U.S. District Court for the Northern District of Ohio, elaborated on summary judgment rulings on Robert Jowers' allegations of negligence, misrepresentation, and punitive damages and on various affirmative defenses.
