FORT LAUDERDALE, Fla. - A Broward County Circuit Court judge will hear argument on April 10 as to whether a silica plaintiff properly served claims against Pulmosan Safety Equipment Corp. through the Florida Secretary of State. Forte v. Air Liquide America, et al., No. 07.007145(27) (Fla. Cir. Ct., Broward Cty.).
In a March 4 response to Pulmosan's motion to quash service of his Florida silica complaint, James Forte maintains that his decision to serve the Secretary of State was the correct one, given that Pulmosan's dissolution was recently suspended by a state court judge in New York.
