W.Va. Trial Now Expected to Start in Early Spring




CHARLESTON, W.Va. - A trial that was to have begun on Feb. 19 will be rescheduled after a March 14 status conference, sources have told HarrisMartin Publishing. Baldwin v. Lincoln Electric Co., et al., No. 03-C-3220 (W.Va. Cir. Ct., Kanawha Cty.).

A source said that it is likely that trial in the case brought by Bemis and Kathryn Baldwin will be scheduled for early spring.

The Baldwins allege that Lincoln Electric, Hobart Brothers and other defendants concealed the dangers associated with their welding products and are guilty of fraudulent misrepresentation and conspiracy (See HarrisMartin's Litigation Watch: Welding Fumes, Jan. 2008).
