PORT GIBSON, Miss. - Defendants in a silica case that recently ended in a mistrial have moved to ensure that evidence related to the plaintiff's lost wages and past and future medical expenses cannot be presented in a second trial. Westrope v. Pangborn Corp., et al., No. 2007-38 (Miss. Cir. Ct., Claiborne Cty.).
In several motions in limine filed Feb. 8, Clemco Industries Corp. and Precision Packaging also urge the court to prevent certain experts from testifying that plaintiff James Westrope has silicosis or silica-related lupus.
