Pa. Defendants Can Join Parties from N.Y. Silica Action




PHILADELPHIA - Defendants in a Pennsylvania silica suit have been granted permission to join several defendants sued by the same plaintiff in a New York action that was eventually dismissed after most of the parties settled. Parker v. New Jersey Silica Sand Co., et al., No. March Term 2007, No. 00394 (Pa. Comm. Pls., Philadelphia Cty.).

Philadelphia County Common Pleas Court Judge Allan L. Tereshko on Dec. 7 granted a motion for leave to file the joinder complaint, giving defendants New Jersey Silica Sand Co., Warner Co. and Waste Management of Pennsylvania Inc. an opportunity to seek indemnity and contribution …
