JACKSON, Miss. - The Mississippi Supreme Court will soon hear argument in a consolidated appeal of decisions from two trial court judges who opted not to sanction plaintiffs' counsel for their role in the federal silica MDL proceedings. Clark Sales & Rental Inc., et al. v. James Braxton, et al., No. 2006-CA-01577 (Miss. Sup. Ct.).
An order was entered Dec. 3 in the state's highest court, setting oral argument for March 5 in the appeal by several defendants who claim that the trial courts erred in refusing to follow the directive of federal MDL Judge Janis Graham Jack and sanction …
