Orders End Fight Over Silica Plaintiff's Previously Settled Asbestos Claim

JACKSON, Miss. - The last two defendants in a Mississippi silica case have been dismissed, leaving unanswered the question of whether a plaintiff who previously settled an asbestos injury claim can pursue a silica claim for the same injury. Trotter v. Pulmosan Safety Equipment, et al., No. 06-619 (S.D. Miss.).
According to court filings in the U.S. District Court for the Southern District of Mississippi, Pulmosan Safety Equipment Corp. and American Optical Corp. were dismissed with prejudice Dec. 12 from a silica case filed by Leroy Trotter Jr.
