Pulmosan Moves to Quash Service on Fla. Secretary of State

FORT LAUDERDALE, Fla. - Defendant Pulmosan Safety Equipment Corp. has moved to quash service of a Florida silica complaint, claiming the suit must be served on the company's directors in accordance with state law governing dissolved corporations. Forte v. Air Liquide America, et al., No. 07.007145(27) (Fla. Cir. Ct., Broward Cty.).
Pulmosan filed its motion to quash Dec. 18 in Broward County Circuit Court, responding to plaintiff James Forte's substituted service of process upon the Secretary of State.
Service of Forte's complaint was based on Florida statutes §48.181 and §48.161, which designates the Secretary of State as an agent …
