Judge Wants Position Statements from Each Plaintiff in Failed Class Action

CLEVELAND -- Plaintiffs who had previously requested a Dec. 7 deadline for notifying the court what they plan to do with their failed class action welding fume claims have all missed this self-imposed deadline, the court said in a Jan. 7 case management order. In Re: Welding Fume Products Liability Litigation, MDL No. 1535; Steele v. A.O. Smith (N.D. Ohio).
As such, the U.S. District Court for the Northern District of Ohio has given the plaintiffs until Feb. 7 to submit the required position statement or face dismissal.
