CLEVELAND -- An Ohio welding fume plaintiff whose claims were dismissed entirely earlier this year has filed a brief appealing the lower court's order, stating that welding manufacturers have been "misinforming welders of the inherent dangers in welding fumes" since 1952. Boyd v. Lincoln Electric, et al., No. CA-07-090315 (Ohio Ct. App., 8th Dist.).
Sources told HarrisMartin that the defendants sought, and on Dec. 12 were granted, an extension for filing their response brief in the Ohio Eight District Court of Appeals. Their brief is now due Dec. 28, according to the court's online docket.
