CLEVELAND -- An Ohio state court is expected to make a decision soon after hearing arguments Dec. 11 on whether to require welding fume plaintiffs to produce a valid diagnosis of a neurological injury, sources told HarrisMartin. In re: Welding Rod Civil Actions Products Liability Litigation, No. CV 04-531703 (Ohio Ct. Comm. Pls., Cuyahoga Cty.).
During arguments before the Ohio Court of Common Pleas for Cuyahoga County, the defendants asked the court to require plaintiffs to produce a diagnosis or dismiss the claims.
