W.Va. Case Slated for Jan. 2008 Trial Voluntarily Dismissed by Plaintiffs

CHARLESTON, W.Va. -- Plaintiffs in an upcoming West Virginia case slated for trial have voluntarily dismissed their welding fume lawsuit just prior to expert depositions, sources told HarrisMartin. Bond, No. 06-C-322 (W.Va. Super. Ct., Mingo Cty.).
According to sources, plaintiff depositions had been completed in the West Virginia Superior Court for Mingo County welding fume case and expert depositions were scheduled to begin when the plaintiffs opted to dismiss their claims.
Prior to the dismissal, HarrisMartin had reported the expert depositions were scheduled for Nov. 10 in anticipation of a Jan. 8, 2008 trial date.
