LOS ANGELES - A California judge has sustained the demurrers of numerous defendants in a dust case who claimed the plaintiffs failed to include enough basic information about their exposures and injuries to determine whether the claims were timely. Navarrette, et al. v. J.H. Armington Inc., et al., No. PC033370 (Calif. Super. Ct., Los Angeles Cty.).
Judge Wendell Mortimer Jr. of the Los Angeles County Superior Court issued the ruling among several others following a hearing that took place in June 2007, and after the plaintiffs has amended their complaint four times to cure deficiencies in their prior lawsuits.
