Abrasive Product Couldn't Have Caused Plaintiff's Injury, Company Says

OAKLAND, Calif. - An abrasive blasting product manufacturer that recently lost its bid for summary judgment in a California silica case is re-asserting its position that the product allegedly responsible for causing the plaintiff's injury doesn't produce silica dust at all. McClarty v. Lone Star Industries Inc., et al., No. RG05-210545 (Calif. Super. Ct., Alameda Cty.).

In a statement filed Oct. 22 ahead of mandatory settlement conferences planned in the expedited Alameda County Superior Court case filed by Eugene McClarty, defendant CanAm Minerals argues that McClarty has failed to show that he was ever exposed to the company's product.
