OAKLAND, Calif. -- A California court has denied several dispositive motions brought by the defendants in a welding fume that is scheduled to be the first in California to proceed to trial later this month. Welding Product Cases, JCCP 004368; King, et al. v. BOC Group, et al., No. RG07344706 (Calif. Super. Ct., Alameda Cty.).
In an October 29 order, the Superior Court for Alameda County denied motions for summary judgment that claimed the plaintiffs failed to sufficiently bring claims for failure-to-warn, false representation and punitive damages.
