NEW ORLEANS -- A Louisiana judge has denied summary judgment motions seeking dismissal of the welding fume claims brought by a plaintiff whose trial was scheduled to begin Oct. 10, but was continued to an undetermined date, sources told HarrisMartin. Joseph, et al. v. A.O. Smith Corp., et al., No. 2003-16965 (La. Civil Dist. Ct., Parish of Orleans).

The Louisiana Civil District Court for the Parish of Orleans clerk's office told HarrisMartin that a notice of judgment was entered Oct. 8 denying defense challenges to failure-to-warn claims and claims asserted under the Louisiana Products Liability Act.
