CLEVELAND -- While the defendants named in an upcoming welding fume trial have filed more motions to dismiss, the plaintiffs have supported their claims, saying that they have adequately pled that the defendants' actions were both negligent and resulted in injury. Tamraz, et al. v. Lincoln Electric, et al., No. 04-18948; In re: Welding Fume Products Liability Litigation, MDL No. 1535 (N.D. Ohio.).
On Sept. 14, the plaintiffs specifically opposed defense motions for summary judgment on claims for common law fraud and aiding and abetting pending in the U.S. District Court for the Northern District of Ohio. See Related Story …
