WAPAKONETA, Ohio - A former foundry worker is facing possible dismissal of his silica claim after defendants alleged that he has failed to support his case with documentation sufficient to show that he has a prima facie injury claim under Ohio law. Mabry, et ux., v. 3M Co., et al., No. 2007CV0157 (Ohio Comm. Pls., Auglaize Cty.).

Defendant Pangborn Corp. filed a motion Aug. 6 in Auglaize County Common Pleas Court, seeking dismissal of Walter Mabry's silica claim because he failed to submit documentation that he is physically impaired as a result of his exposure.
