HOUSTON - An Alabama man may pursue his silica complaint in Texas after a judge denied a motion for summary judgment filed by defendants who claimed, among other things, that the plaintiff's suit was time-barred under Alabama law. Moore v. Air Liquide America Corp., et al., No. 2005-58856 (Texas Dist. Ct., Harris Cty.).
Sources told HarrisMartin Publishing that Judge Tracy Christopher, the Harris County District Court judge who presides over the state's coordinated silica proceedings, denied statute of limitations motions by several defendants on Sept. 24.
