NEW ORLEANS -- Defendants in a Louisiana welding fume case scheduled for an October trial have sought to dismiss several of the plaintiff's claims, contending that the plaintiff has insufficient evidence to establish product identification and failure-to-warn claims and that her claim asserted under the Louisiana Products Liability Act precludes other claims. Joseph, et al. v. A.O. Smith Corp., et al., No. 2003-16965 (La. Civil Dist. Ct., Parish of Orleans).
