Court Dismisses Retailers Lawsuit Against Welding Rod Manufacturers

HATTIESBURG, Miss. -- A federal court has dismissed a welding rod retailer's indemnification claims against several manufacturers, finding in part that because the manufacturer's liability has not been established, the claims fail. Columbia Welding Service v. The BOC Group, et al., No. 06-00128 (S.D. Miss.).
In the July 13 order, the U.S. District Court for the Southern District of Mississippi rejected Columbia Welding Service, Inc.'s common law indemnity, statutory indemnity, uniform commercial code liability and promissory estoppel and detrimental reliance claims.
