OAKLAND, Calif. - 3M Co. has asked a state court judge for more time to question a plaintiff about the circumstances surrounding his use of the company's respiratory protection products, which he says played a role in causing his silica-related injury. McClarty v. Lone Star Industries Inc., et al., No. RG05210545 (Calif. Super. Ct., Alameda Cty.).
In a statement filed July 19, 3M says the 10 hours that defense counsel spent deposing plaintiff Eugene McClarty weren't enough to get a clear picture of McClarty's work history and whether he regularly used the 3M masks he identified during discovery.
