Oklahoma Plaintiffs Facing Motions to Dismiss for 2nd Time

PRYOR, Okla. - Defendants in 23 silica cases filed recently in Oklahoma have moved to dismiss the petitions citing the plaintiffs' alleged failure to include specific information they say is needed to defend the cases. Anderson v. Airgas Safety, et al., No. CJ-2007-50 (Okla. Dist. Ct., Mayes Cty.).

A handful of the more than 50 defendants named in each case began filing the motions in June in the Mayes County District Court. According to one motion, the plaintiffs have failed to provide even minimal notice to any of the defendants concerning the nature of that allegations against them.
