Chevron Seeks Dismissal, Says It Never Made a Silica Product




OAKLAND, Calif. - Fresh off losing a bid to have a silica case transferred to a nearby county, a well-known petroleum manufacturer has filed a demurrer, claiming the suit fails to explain why the company has been named as a defendant in the case. Casasus v. A-1 Aggregates, et al., No. RG05214053 (Calif. Super. Ct., Alameda Cty.).

The demurrer was filed May 7 in Alameda County Superior Court by Chevron U.S.A., which, along with more than 40 other defendants, has been accused of causing plaintiff Jose Cesena Casasus's silica-related injury.
