OAKLAND, Calif. -- A California plaintiff has opposed a defense request for a second neurological exam, saying that the court specifically said in an order that fact discovery would not be reopened despite a trial continuance. In re: Welding Products Cases, JCCP No. 004368 (Calif. Super. Ct., Alameda Cty.).; King, et al. v. BOC Financial Corp., et al., No. 04-429012 (Calif. Super. Ct., San Francisco Cty.).
In the May 22 opposition, plaintiff Val King says the defense motion is "in direct violation" of several case management orders issued by the Alameda County Superior Court.
