CLEVELAND - Defendants in the Ohio silica litigation have begun the process of trying to show that several of the cases plaintiffs' counsel have designated as "impaired" do not actually meet the court's medical criteria for proceeding to trial. Kiser v. Allied Mineral Products Co., et al., No. 475687 (Ohio Comm. Pls., Cuyahoga Cty.).
More than a dozen motions were filed May 16 by defendants who contend that the medical documentation provided in support of the plaintiffs' claims reveal that the claimants remain unimpaired as a result of their silica exposure. The motions request the cases be administratively dismissed in …
