Parties Still Waiting on Ohio Summary Judgment Ruling; Sept. Trial Set

CLEVELAND -- An Ohio state welding fume case in which summary judgment motions are still pending remains on the court's September 2007 trial docket, sources told HarrisMartin. Boyd v. Lincoln Electric Co., et al., No. CV-04-545413 (Ohio Ct. Comm. Pls., Cuyahoga Cty.).

The sources also indicated that Justice Francis E. Sweeney of the Ohio Court of Common Pleas for Cuyahoga County has not indicated when he will rule on the summary judgment motions made by manufacturing defendants named in Joseph Boyd's complaint.

Oral arguments pertaining to the motions took place on Dec. 12, 13 and 14 before Justice Sweeney. …
