OAKLAND, Calif. - A California judge has denied a motion for judgment on the pleadings filed in numerous silica cases that defendants contend are frivolous because they fail to include sufficient information about the alleged injuries and their purported causes. Bradley v. A-1 Aggregates, et al., No. RG05214038 (Calif. Super. Ct., Alameda Cty.).
In a ruling issued May 7, Alameda County Superior Court Judge Robert Freedman noted that the relief sought by the defendants in their September motion is not available at this time, "solely by way of an attack on the operative pleading."
