MT. VERNON, Ill. -- Defendants who won an Illinois welding fume trial claim in their appellate petition that the trial court's award of a new trial on discovery violations should be reversed because the documents allegedly withheld would not have changed the outcome of the trial. Winterman v. BOC Group, et al., No. 5-06-0679 (Ill. App. Ct., 5th Dist.).
The Illinois 5th District Appellate Court told HarrisMartin the plaintiff's response brief is due on June 11 after which oral arguments will be scheduled.
