OAKLAND, Calif. -- Defendants in what is scheduled to be the first California welding fume case to go trial have requested a court order compelling a second neurological examination of the plaintiff.In re: Welding Products Cases, JCCP No. 004368 (Calif. Super. Ct., Alameda Cty.).; King, et al. v. BOC Financial Corp., et al., No. 04-429012 (Calif. Super. Ct., San Francisco Cty.).
The defendants contend in the April 27 brief filed in the Alameda County Superior Court that the exam is necessary because the plaintiff is contending that his symptoms are progressing.
