Caterpillar: Decision on Summary Judgment Motion 'Long Overdue'

CLEVELAND -- Welding Fume Products Liability Litigation MDL defendant Caterpillar has noted in a recent reply brief that the plaintiffs' opposition to motions for summary judgment fail to address key propositions asserted by Caterpillar, including a motion to dismiss negligence and product liability claims. In re: Welding Fume Products Liability Litigation, MDL No. 1535 (N.D. Ohio).
In the April 13 reply brief filed in the U.S. District Court for the Northern District of Ohio, Caterpillar contends that the plaintiffs' opposition reasserts claims from initial complaints.
