CLEVELAND -- Plaintiffs asking for class certification in a medical monitoring lawsuit have filed a reply in support of their motion, saying that the measure is "timely, necessary and efficacious" for welders. In Re: Welding Fume Products Liability Litigation, MDL No. 1535 (N.D. Ohio).
In an April 11 reply brief filed in the U.S. District Court for the Northern District of Ohio, the plaintiffs note that the court is not required to consider the merits of the medical monitoring claim when determining class certification.
