Silica Defendants Ask Judge to Order Production of Pulmonary Data

HOUSTON - Defendants have filed a motion asking the state Silica MDL judge to order plaintiffs to produce all pulmonary diagnoses and evaluations, claiming that the evidence should reveal that the vast majority of the 7,000 pending claims are questionable. In Re: Texas State Silica Products Liability Litigation, No. 2004-70000 (Texas Dist. Ct., Harris Cty.).
Filed April 3 in Harris County District Court, the motion states that defendants expect the evaluations will provide reasons for why only 45 plaintiffs have provided medical reports supporting their alleged injuries since the cases were transferred to the MDL nearly two years ago.
