Defendants Seek Dismissal of 12 Welding Lawsuits for Failure to Prosecute

CLEVELAND -- The defendants involved in the Welding Fume Products Liability Litigation MDL have moved to dismiss 12 welding fume lawsuits for failure to prosecute. In re: Welding Fume Products Liability Litigation, MDL No. 1535 (N.D. Ohio).
The April 3 motion filed in the U.S. District Court for the Northern District of Ohio notes that several plaintiffs' law firms have already filed a joint motion to withdraw as counsel from the specified cases.
The dismissal would affect 12 plaintiffs who had been severed from the multi-plaintiff Adames case, including six West Virginia residents, five Texas residents and one Missouri resident. …
