Appeals Court Denies 3M Attempt to Vacate Texas Orders
April 4, 2007
HOUSTON - A Texas Court of Appeals has denied a petition for writ of mandamus filed by silica defendant 3M, which had urged the appellate court to vacate certain pre-trial discovery orders that have been entered in the state's silica MDL proceeding. In Re 3M Company, No. 01-07-00201-CV (Texas Ct. App., First Dist.).
The per curiam First District Court of Appeals issued the ruling without further comment on March 29, about two weeks after 3M asserted in its petition that three master discovery orders entered by Harris County District Court Judge Tracy Christopher deprived them of their due process rights.
