HOUSTON - The Texas MDL silica judge has determined that, as a matter of law, sellers of multi-use air compressors do not have a duty to warn of any dangers associated with the use of their products in conjunction with silica sand. Mullens v. American Optical, et al., No. 2005-07992 (Texas Dist. Ct., Harris Cty.).

Harris County District Court Judge Tracy Christopher's Feb. 5 ruling is the latest in a string of decisions where manufacturers of air compressor equipment have been awarded summary judgment on the duty to warn issue.
