X-ray Company Appeals Fine, Says It Screened DEP Employees in the Past

HARRISBURG, Pa. - An X-ray screening company fined $80,500 by a state DEP for conducting exams without a license has appealed the penalty, claiming it has conducted identical unlicensed screenings for the very same state department that levied the sanction.

MOST Health Services Inc., of Voorhees, N.J., filed a notice of appeal Feb. 22 with Pennsylvania's Environmental Hearing Board, challenging the fine as 'unwarranted, excessive' and in violation of the Radiation Protection Act. MOST also contends that it lacks the financial ability to pay the fine assessed by the state Department of Environmental Protection on Jan. 25.
